1. Agreement to Terms

By accessing or using this website, web application, mobile application, or any related services (collectively, the “Service”), you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions (the “Terms”). If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility

You must be at least 18 years of age, and capable of forming a binding contract, to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements and that your use complies with all applicable laws and regulations.

3. Description of Service

The Service provides budgeting, cash‑flow, and financial tracking tools; analytics, dashboards, and visualizations of financial information; and AI‑driven insights, simulations, and analysis related to investments, portfolios, and financial behavior. The Service is designed for general informational and educational purposes only and is not tailored to your individual financial situation.

4. No Investment, Financial, or Tax Advice

WealthPulse, its owners, employees, contractors, and affiliates are not registered investment advisers, broker‑dealers, financial planners, or tax professionals. Your use of the Service does not create any fiduciary, advisory, or client relationship between you and WealthPulse. All information, AI‑generated content, models, scores, or insights are for general informational and educational purposes only and do not constitute individualized financial, investment, legal, or tax advice. Past performance, back‑tested data, and hypothetical or simulated results do not guarantee future performance. Markets are inherently volatile and uncertain. You may lose some or all of your investment capital. You are solely responsible for all financial and investment decisions you make.

5. User Accounts and Security

You may need to create an account to access certain features of the Service. You agree to provide accurate, current, and complete information and to update it as needed. You are solely responsible for maintaining the confidentiality and security of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other security breach.

6. Subscription, Free Trial, and Billing

We may offer a 7‑day free trial to new users. Unless you cancel your subscription before the end of the free trial period, your account will automatically convert to a paid subscription at $9.99 per month, and your chosen payment method will be charged on a recurring monthly basis. Subscription fees are billed in advance on a recurring monthly basis until canceled. You may cancel at any time through your account settings or by contacting us at support@wealthpulse.tech. Except where required by applicable law, all fees are non‑refundable.

7. Permitted Use and Prohibited Conduct

You agree to use the Service only for lawful purposes. You may not reverse engineer, copy, distribute, or resell any part of the Service, use automated bots or scrapers, or use the Service to develop competing financial or AI products in violation of our rights.

8. User Content and Data

You retain ownership of your User Content. By providing User Content, you grant WealthPulse a non‑exclusive, worldwide, royalty‑free license to use your User Content solely for the purpose of providing and improving the Service. We may aggregate and de‑identify User Content to generate statistical or analytical insights, which will not identify you personally.

9. Intellectual Property

The Service and all related software, code, algorithms, models, text, graphics, logos, and trademarks are owned by or licensed to WealthPulse and protected by intellectual property laws. You are granted a limited, non‑exclusive, non‑transferable, revocable license to access and use the Service for personal or internal business use only.

10. Disclaimers of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind. WealthPulse expressly disclaims all implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement.

11. Limitation of Liability

To the maximum extent permitted by applicable law, WealthPulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability shall not exceed the greater of the fees you paid in the three months preceding the claim or US $50.

12. Indemnification

You agree to indemnify and hold harmless WealthPulse from and against any claims, liabilities, damages, losses, costs, and expenses arising out of your use of the Service, your violation of these Terms, or any User Content you submit.

13. Third‑Party Links and Services

The Service may contain links to third‑party websites or services. We are not responsible for the content, policies, or practices of any third‑party websites.

14. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice.

15. Changes to These Terms

We may update these Terms from time to time. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the revised Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Florida. Any disputes shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida.

17–18. Severability and Entire Agreement

If any provision is held unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement between you and WealthPulse with respect to the Service.
